DMCA Copyright Policy

VauntSpace respects copyright and expects everyone using vauntspace.com to do the same. This policy describes how a copyright owner can notify us of alleged infringement and how a user can contest a takedown, under the Digital Millennium Copyright Act (17 U.S.C. § 512) and equivalent laws.

1. Submitting a takedown notice

If you believe material available on vauntspace.com infringes your copyright, send a written notice to our designated DMCA agent (below). To be effective under 17 U.S.C. § 512(c)(3), the notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or the person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed (or, for multiple works on one site, a representative list).
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient for us to locate it (URL is best).
  4. Your name, address, telephone number, and email.
  5. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Notices that don't include all of the above may not be actionable.

False notices: knowingly misrepresenting that material is infringing can subject you to liability for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f).

2. Counter-notice

If content of yours was taken down and you believe it was removed by mistake or misidentification, you may send a counter-notice to the same agent, containing:

  1. Your physical or electronic signature.
  2. Identification of the material removed and the location where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
  4. Your name, address, and telephone number, plus a statement that you consent to the jurisdiction of the federal court in your judicial district (or, if outside the US, the Southern District of Ohio), and that you will accept service of process from the original complainant or their agent.

On receipt of a valid counter-notice we may forward it to the original complainant and restore the material in 10 to 14 business days unless we receive notice of a filed lawsuit.

3. Repeat infringers

VauntSpace terminates the accounts of users who are found to be repeat copyright infringers, in appropriate circumstances and at our sole discretion.

4. Our own copyright

This policy also governs enforcement of VauntSpace's copyright in the VauntSpace Materials described in section 9a of our Terms of Service. Where a cloned site, mirror, scraped dataset, or model trained on VauntSpace Materials is discovered, VauntSpace will pursue takedown with the offending host, its upstream infrastructure providers, and appropriate courts, and will seek every remedy available at law and in equity.

Formal registration of the designated agent with the U.S. Copyright Office (as contemplated by 17 U.S.C. § 512(c)(2)) will be completed at the Directory of Agents at dmca.copyright.gov. In the interim, VauntSpace accepts DMCA notices at the email address above and will act on them in accordance with the elements set out in section 1 of this policy.
